The Claim

President Trump’s new executive order targeting social media companies is in violation of the First Amendment.

Emerging story

A new lawsuit filed by the Center for Democracy & Technology claims that President Trump’s executive order regarding social media, which targets Section 230 of the 1996 Communications Act that shields internet companies from liability for blocking or otherwise censoring users’ content if they act in “good faith," is under scrutiny

Misbar’s Analysis

A new lawsuit brought forth by the Center for Democracy and Technology challenges President Trump’s executive order that looks to reinterpret Section 230 of the 1996 Communications Act. The lawsuit from the organization claims that the executive order against social media companies is retaliatory and in complete violation of free speech protections offered by the First Amendment.

Critics argue that Trump’s executive order stems from Twitter recently flagging specific tweets made by the President for being misleading, where Trump claimed that mail-in voting would be “substantially fraudulent” and lead to a “rigged election.”

While a new lawsuit challenges President Trump’s executive order against social media companies saying that it violates free speech protections offered by the First Amendment, it is unclear if the lawsuit holds weight. As a result, we label the claim that President Trump’s new executive order targeting social media companies is in violation of the First Amendment as “Misleading”, as the lawsuit is pending and no definitive conclusion has been reached.
