Following the death of Supreme Court Justice Ruth Bader Ginsburg on September 18, 2020, Democratic Presidential Nominee Joe Biden delivered a speech at the National Constitution Center in Philadelphia, where he said that Ginsburg’s seat should not be filled before the upcoming presidential election. In the speech, Biden claimed, “there’s no court session between now and the end of this election."
Users across social media disputed the claim, making fun of the candidate’s incorrect statement and pointing out that he was wrong.

Misbar’s investigation shows that Biden’s claim is false. Our analysis looked at the Supreme Court calendar between now and election day, which showed six oral arguments scheduled before the election and one scheduled in November on Election Day.
As such, Joe Biden’s claim that the Supreme Court has no session scheduled before Election Day is incorrect.
