In September 2020, a Facebook post which has since been deleted claimed that the late Supreme Court Justice Ruth Bader Ginsburg was both nominated and confirmed 43 days before a presidential election.

The Misbar team has determined that this claim is false. President Bill Clinton announced the nomination of Ruth Bader Ginsburg on June 14, 1993. The U.S. Senate received her nomination on June 22, 1993, and she was later confirmed in a bipartisan vote on August 3, 1993. The exact time it took for Ginsburg’s nomination to be confirmed was 42 days and it was not leading up to an election. The next presidential election was not held until November 5, 1996.
