Democratic Presidential nominee Joe Biden will pack the Supreme Court if elected.

Misbar’s Analysis

Throughout American history, there have been a few instances of expansions of the Supreme Court. The last time this was done was in 1937, when FDR wanted to ensure the survival of his New Deal policies.

After the Republicans blocked Barrack Obama’s supreme court nomination in 2015, there has been some clamor over whether or not the Democrats should pack the court with more justices. Now that Trump has gotten two – and quite possibly three – nominations, the question has become more important than ever.

Biden has been somewhat reluctant on the subject. During the Vice-Presidential debate, Kamala Harris dodged the question of whether or not Biden plans to expand the court.

Recently, however, Joe Biden has said that he’s “not a fan” of court packing.

This statement is a bit vague. He might not be a fan of doing it, but he may feel (or say) that he is forced to do, especially because of the current hearings. Kamala Harris is open to it, but that doesn’t mean she wants to initiate the debate. Republicans have also been accused of packing courts in the past decade, which points to a change in precedent.
