Misbar’s investigation found that with a vote of 52-48, the Senate voted to confirm Amy Coney Barrett on October 26, 2020, thus cementing the Supreme Court’s conservative majority at 6-3.
Democrats attempted to delay Barrett’s confirmation, which came in the stead of Justice Ruth Bader Ginsberg’s recent passing, because it was so close to Election Day. Republicans said that that rule doesn’t apply when the same party controls the Senate and the White House.
Barrett is the fifth woman to be appointed in the Supreme Court’s 231-year-history. Only Republicans supported her confirmation; and one Republican – Senator Susan Collins – voted against Barrett’s confirmation in a stated desire to be “fair and consistent.” According to the Senate Historical Office: “No other Supreme Court justice has been confirmed on a recorded vote with no support from the minority party in at least 150 years.”
