Legal Votes Don’t Indicate Trump Win

The Claim

If you count the legal votes, U.S. President Trump easily wins the presidential election.

Emerging story

On the night of November 5, 2020, U.S. President Donald Trump said: “If you count the legal votes, I easily win.” 

The claim soon went viral on social media.

Misbar’s Analysis

Misbar’s investigation found that Trump’s statement is unfounded. While the Trump campaign has launched litigation against several states, claiming election irregularities and fraud, there is no evidence that election fraud of any sort has taken place.

Former Republican Senator Rick Santorum said about Trump's declaration: “No Republican elected official will stand behind that statement."

Republican Senator Pat Toomey concurred: "I am not aware of any significant level of fraud that's going on. Nobody has brought anything to my attention that causes me to say there's a huge case of fraud that needs to be immediately addressed.”

While this election has the highest amount of mail-in ballots of any election ever due to the coronavirus pandemic, that does not mean that these votes are illegal. Since legal votes are being counted and Trump still hasn’t won, we rate his claim as false.
