Smartmatic, a voting machine software company, is sending legal notices to news outlets.

The claim that Smartmatic was sending legal notices to several right-wing news outlets went viral on December 14, 2020.

Misbar’s Analysis

In recent months, many right-wing new outlets including Fox News have been questioning the integrity and effectiveness of voting machines. Fox News has hosted Rudy Giuliani and other top Republicans who allege that the American voting system has been compromised. Many of these allegations have been debunked by Misbar.

Smartmatic, a company that provides that software for these voting machines, seems to have taken action. Legal notices have been sent to Fox News, Newsmax, and One America News. These legal notices aren’t lawsuits. They essentially make demands that, if refused, may result in lawsuits. One of these demands is for these news outlets to denounce their prior statements with an amount of coverage akin to their formerly negative statements. This probably won’t happen, but Misbar can’t predict the future.

We did find that there appears to be merit to these legal notices, as the sheer number of unsupported allegations has been staggering. From conspiracy theories about CIA-owned server facilities in Germany to tall tales of ballots thrown in the creek, there has been an unprecedented number of unfounded claims in the latest U.S. presidential election.
