During an interview with Fox News on January 2, 2021, White House trade advisor Peter Navarro claimed that Vice president Mike Pence could postpone the January 20 inauguration.

Misbar’s Analysis

The Misbar team has determined that the claim is false.

While appearing on the Fox News show Justice with Judge Jeanine, Navarro said that Vice President Pence could order an investigation into the 2020 election results and that he could postpone the inauguration. After making the suggestion, Judge Jeanine Pirro said that the inauguration "cannot be changed, that's constitutional." Following that comment, Navarro responded by saying, “Well, it can be changed, actually. We can go past that date. We can go past that date. We can go past that date if we need to." Pirro did not press him following the comment.

While members of the GOP have vowed to fight to overturn the 2020 presidential election in an effort to hand victory over to President Trump, the date of the inauguration (January 20th) is written in the Twentieth Amendment of the U.S. Constitution. According to the amendment: “The terms of the President and Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.”

While Navarro did make such a claim, the constitution cannot be changed between now and Inauguration Day; the inauguration will occur on January 20th as planned.
