Misbar’s Analysis
Misbar’s investigation found this claim to be false. Impeachment alone will not stop Donald Trump from running for president in 2024. Trump was impeached for the second time on January 13th, 2020. Now the process moves to the Senate, where they will hold a trial. The Senate needs a two-thirds majority to convict him and remove him from office.
According to the New York Times, “if the Senate were to convict him, the Constitution allows a subsequent vote to bar an official from holding ‘any office of honor, trust or profit under the United States.’ That vote would require only a simple majority of senators.”
According to CNN, “There is at least some uncertainty about the disqualification issue, since no president has ever been removed from office by the Senate and only judges have been disqualified from future office.” The language in the constitution brings into question whether the presidency counts as an "Office of honor, Trust or Profit under the United States.”
If President Trump is convicted by the Senate and the following vote passes to bar him from holding office, the case could be brought to the Supreme Court. Impeachment alone does nothing to stop Donald Trump from running for President in 2024.
