Under Biden, illegal immigrants that are convicted of assault and rape will NOT be deported.

Origin: On February 8th, 2021, Ryan Fournier, founder of Students for Trump, tweeted that ”Under Biden, illegal aliens that are convicted of assault and rape will NOT be deported.”

This tweet received more than 7k retweets. Many people commented suggesting that Biden and his administration don’t care about America and that his policies will make America less safe.

Investigation: 

Misbar’s investigation found this claim to be fake. This tweet comes after news that the Department of Homeland Security is preparing to issue new guidelines to U.S. Immigration and Customs Enforcement (ICE) agents regarding the deportation of illegal immigrants convicted of crimes.

According to the Washington Post, “Agents will no longer seek to deport immigrants for crimes such as driving under the influence and assault, and will focus instead on national security threats, recent border crossers and people completing prison and jail terms for aggravated felony convictions.” Acting director Tae Johnson added, “These convictions would not include drug based crimes (less serious offenses), simple assault, DUI, money laundering, property crimes, fraud, tax crimes, solicitation, or charges without convictions.”

Under Federal law, the list of crimes that are considered ‘Aggravated Felonies’ include: murder, rape, sexual abuse of a minor (which can include statutory rape), simple battery, drug trafficking, trafficking in firearms or destructive devices, various other offenses concerning firearms or explosive materials, racketeering, and many more.

According to ICE officials, “Crimes such as sex offenses remain a top priority.” 

This means that illegal aliens convicted of rape and certain assault charges will still be deported. Our investigation has found that Ryan Fournier’s tweet is baseless and lacks any evidence to support his claims.
