Trump Didn’t Win 2/3 of Election Lawsuits

Misbar’s Analysis

After the election, Trump turned to the courts. According to a USA Today article written in January, he and his legal team filed 62 lawsuits and lost 61 of them.

Overa month later, John Droz compiled a spreadsheet on these lawsuits and came to a different conclusion. He asserted that 2/3 of cases, when “merits are considered,” were in favor of Trump. He defined “merits” as occasions when the court didn’t throw the case out entirely. Some viewed this as proof that the election was rigged and the media tide is turned against Trump, so the spreadsheet was shared on social media and written about in all sorts of publications.

However, Misbar's investigation found that this spreadsheet is arbitrary. There are 81 cases listed – a full 20 more than discussed in USA Today. Some of these cases were merely requests for voter data, which everyone can get. A few others are just making data more obvious, or are petitions to extend voting hours. There were also some decisions that were made and later overturned. None of these had any meaningful effect. Moreover, Droz’s assumption that cases being thrown out doesn’t equate to losing a case is plainly untrue. Droz is also not a lawyer nor does he have a law degree – he’s a real estate agent – so he’s not a valid source for legal commentary.
