A man who does not want the COVID-19 vaccine is suing his workplace for requiring it as a condition of employment.

Emerging story

Shortly after COVID-19 vaccines were approved by the FDA, people started wondering if they might become mandatory. In December, 2020, a range of news sites began speculating on whether employers would require their employees to take the vaccine. 

As far as general legal action, CNBC recently reported that individuals cannot sue companies such as Moderna or Pfizer for vaccine side effects. The source also stated that the U.S. government probably wouldn’t compensate individuals for vaccine damages. This may have set the stage for individuals to consider lawsuits against their employers for mandating coronavirus vaccines.

In early March, news broke about the first US lawsuit against mandatory vaccines. 

Isaac Legaretta, a detention center officer based in New Mexico, filed the lawsuit against his workplace. Specifically, the lawsuit is aimed at his county manager and his supervisor. 

Legaretta’s attorney, Ana Garner, claimed that her client was threatened with being fired if he refused to take a COVID vaccine. She her client are also concerned about the risks accociated with the vaccine. "You can’t be forced to be a human guinea pig when a product is experimental," she told Bloomberg Law.

However, it appears all but certain that Legaretta’s lawsuit will only be successful if he can claim that he has health or religious reasons for refusing the vaccine. 

It remains to be seen if future lawsuits will be filed.
