The Claim

Karen Fann, the president of the Arizona State Senate has the authority to decertify her state’s 2020 election results.

Emerging story

On a recent episode of the Real America’s Voice podcast War Room Pandemic, lawyer John Eastman discussed the possibility of Karen Fann, Arizona’s senate president, being able to decertify the results of her state’s 2020 election results. Later, former New York City Mayor and former lawyer to President Trump Rudy Giuliani made further comments that claimed that Fann could decertify the election. 

These claims were then shared on social media, with posts stating that Fann was authorized to decertify the election gaining thousands of interactions.

Misbar’s Analysis

Misbar’s investigation found that it is incorrect to state that the Arizona senate president can decertify the election. Eastman, the lawyer on the podcast, did not state that Fann definitely had the power to decertify the election. He stated that this may be the case if evidence of election fraud was uncovered. Giuliani stated that it would be easy for Fann to decertify the election, but also said that there is no doubt the election was fraudulent. Biden won the Arizona election by almost 10,500 votes. As of July 16th, Arizona election officials have charged just four people with voter fraud, and two of these individuals were Republican voters.

The above source also clarifies that numerous Republican Arizona officials, including Governor Doug Ducey, have confirmed that the election was valid and secure. 

Even if there had been voter fraud in the Arizona election, Karen Fann would not have the power to decertify the election. Fann herself confirmed this recently. In response to a question on One America News Network about who does have the power to decertify the election, she responded, “The Senate body - we do not have the authority to do that.” 

She went on to clarify that the senate only had the power to subpoena information in regard to voter fraud to write future laws regarding elections.
