Emerging story
Social media users are spreading information that non-citizens are being registered to vote in California ahead of the midterm elections in November.
Users claim that a driver's license is all you need to vote, regardless of your citizenship status in the United States.
Misbar’s Analysis
Misbar investigated the circulating claim and found it to be fake.
Non-citizens are not permitted to vote in congressional elections under California law.
Who Can Vote in California?
To vote in California elections, a person must be a U.S. citizen and at least 18 years old, according to the California Constitution and the Secretary of State.
The constitution also states that voters must not be currently serving a state or federal prison term for a felony conviction or have been determined by a court to be mentally incompetent to vote.
Since 2016, San Francisco has only permitted non-citizen parents or guardians to cast ballots in elections for school boards.
Non-citizen parents or guardians are not allowed to vote in any congressional or statewide elections.
However, Misbar was unable to find any evidence that non-citizens who have a driver's license are allowed to vote in California.
2022 Midterm U.S. Elections
On November 8, 2022, the United States midterm elections began.
These are the elections for the House of Representatives and the Senate, the two chambers of the United States Congress.
One-third of the Senate's membership is up for election every two years; the remaining members either serve out their terms or are replaced.
As voting went on Thursday, it was unclear which party would control.
President Biden said at a news conference on Wednesday that the Democrats' performance in the midterms was better than expected and went against predictions of "a giant red wave."
